Nissan Recalls Pathfinders for Faulty Brake Lights

Nissan is starting the new year off on the wrong foot, thanks to a defect that could cause brake lights to be stuck in the “on” position.
The company is recalling some 250,000 Pathfinder sport utility vehicles, Car and Driver reports. Nissan said drivers of recalled vehicles who are frequently in stop-and-go traffic are most likely to notice that their brake lights cannot be turned off.
The malfunctioning lights are not just a potential source of aggravation for Pathfinder drivers. Nissan told the National Highway Traffic Safety Administration that the defect could also cause problems with the brake-shift interlock, which could make it harder to shift out of park or could result in the engine starting without depressing the brake.
“These symptoms could potentially increase the risk of a crash or rollaway,” Nissan said in a notice filed with NHTSA.
The recall covers certain 2013 to 2015 Pathfinders, some of which may have been part of a 2016 recall over the same issue. The company told NHTSA it will begin alerting owners of recalled vehicles on March 1 and ask them to bring their cars to a local dealer for a fix.
Legal Protections for Car Owners in California
Recalls like the one recently announced by Nissan are unfortunately common. Auto manufacturers call back millions of vehicles each year, citing defects that pose serious safety risks.
Fortunately for car owners and lessors in California, the state lemon law gives you some important rights and protections. The Song-Beverly Consumer Warranty Act forces carmakers to perform certain repairs on vehicles while they are under warranty. The law also requires a company that is unwilling or unable to fix a covered car to buy the vehicle back or replace it.
There is no set number of repair attempts or requests that must be made before the law kicks in. That is one reason why it is important to consult an experienced California lemon law attorney. The law also requires car manufacturers to pick up the bill for any legal fees that a person incurs enforcing his or her rights.
